1. IDENTIFICATION AND ACCEPTANCE

These Terms and Conditions govern the access and use of the website lorehoyuela.com and the contracting of services and products offered by Lore Hoyuela, a natural person identified with domicile in Bogotá, Colombia, email info@lorehoyuela.com.

Access to and use of the website and the acquisition of any service or product implies full and unreserved acceptance of these Terms and Conditions. If the user does not agree with any of the terms established herein, they must refrain from using the site and contracting the services.


2. SERVICES OFFERED

Through the lorehoyuela.com website, the following services and products are offered:

2.1 Consulting Services:

  • Take Off: 4-week consulting program

  • Personal Brand Accelerator: 8-week consulting program

  • Digital Authority: 5-month consulting program

2.3 Business Training Services:

  • Conferences, workshops, and keynotes for companies and events

2.4 Free Resources:

  • Templates and downloadable materials available by subscription


3. CONTRACTING PROCESS

3.1 Clarity Session: Contracting is done directly on the website through online payment. Once payment is confirmed, the user will receive an email with the initial brief that must be completed and sent before the session. The session will be coordinated by email within 2 to 3 business days after reviewing the brief.

3.2 Take Off, Personal Brand Accelerator, and Digital Authority Programs: Contracting these programs requires completing the pre-qualification form available on the website, a review by Lore Hoyuela within 24 to 48 business hours, a free 20-minute discovery call, and the submission of a personalized proposal. The contract is perfected with payment confirmation.

3.3 Conferences, workshops, and events: Contracting begins with submitting the quotation form available on the website. Lore Hoyuela will send a personalized proposal within 48 business hours. The contract is perfected with the express acceptance of the proposal and the agreed payment.

3.4 Physical Book: Purchase is made directly on the website or through the indicated platforms. The contract is perfected with payment confirmation.


4. PRICES AND PAYMENT METHODS

4.1 Prices: Prices for services and products are expressed in US dollars (USD) for consulting services and in Colombian pesos (COP) for the physical book purchased through the store in Colombia. Prices are subject to change without prior notice. The applicable price will be the one in force at the time of payment confirmation.

4.2 Payment methods: Payments are processed through Shopify Payments' secure payment gateway. National and international credit and debit cards are accepted. For payments in local currency, the user's bank will make the corresponding conversion according to the exchange rate in force at the time of the transaction.

4.3 Payment confirmation: Once payment is processed, the user will receive an automatic confirmation to the registered email address. This confirmation constitutes proof of the transaction.


5. NO REFUND POLICY

All payments made for consulting and training services are final and irrevocable. No refunds will be issued under any circumstances once payment is confirmed, including but not limited to the following cases: change of mind by the user, lack of time to participate in the process, results not in line with the user's personal expectations, or force majeure situations attributable to the user.

For the physical book, the return policy of the platform through which the purchase was made applies in case of manufacturing defects or shipping errors.

This policy is known and expressly accepted by the user at the time of completing the purchase.


6. OBLIGATIONS OF THE PARTIES

6.1 Obligations of Lore Hoyuela:

  • Provide the contracted services with diligence and professionalism

  • Maintain the confidentiality of information shared by the client during the consulting process

  • Comply with agreed schedules and deliveries

  • Provide the deliverables described in each program

  • Respond to communications within a reasonable time during business days and hours

6.2 Obligations of the user:

  • Provide truthful and complete information in forms and during the consulting process

  • Comply with commitments made, including submitting the brief within established deadlines and punctual attendance at scheduled sessions

  • Perform agreed work between sessions

  • Treat Lore Hoyuela with respect and professionalism in all interactions

  • Not share materials, deliverables, and content of the consulting process with third parties without express authorization


7. RESCHEDULING AND CANCELLATION OF SESSIONS

7.1 Rescheduling by the user: The user can reschedule a session with a minimum of 24 business hours' notice without any additional cost. Rescheduling requests made with less than 24 hours' notice or no-shows without prior notice will be counted as a completed session and will not entitle to replacement.

7.2 Rescheduling by Lore Hoyuela: In the event that Lore Hoyuela needs to reschedule a session, she will communicate it as far in advance as possible and coordinate a new date convenient for both parties.

7.3 Cancellation of the process: In the event that the user decides to abandon the consulting process before its completion, no refund of any amount paid will be made, in accordance with the policy established in section 5 of these terms.


8. INTELLECTUAL PROPERTY

8.1 Site Content: All content published on lorehoyuela.com, including texts, images, designs, logos, methodologies, templates, and downloadable materials, is the exclusive property of Lore Hoyuela and is protected by applicable intellectual property laws in Colombia and internationally. Its reproduction, distribution, modification, or commercial use is expressly prohibited without prior written authorization.

8.2 Consulting Deliverables: The deliverables generated during the consulting processes are for the exclusive use of the client for their personal brand or business. The client may not commercialize them, transfer them to third parties, or present them as their own in training or advisory contexts without the express authorization of Lore Hoyuela.

8.3 Methodology: The work methodology used in the consulting programs is the intellectual property of Lore Hoyuela. Its use, reproduction, or teaching to third parties without express authorization constitutes an infringement of intellectual property rights.


9. CONFIDENTIALITY

Lore Hoyuela undertakes to maintain strict confidentiality of all personal, financial, and strategic information shared by the client during the consulting process. This information will not be disclosed to third parties except by legal obligation. Likewise, the client undertakes not to publicly disclose the content of the sessions without express authorization.


10. LIMITATION OF LIABILITY

10.1 Results: The consulting services offered by Lore Hoyuela are advisory and strategic in nature. The results obtained largely depend on the client's level of implementation, commitment, and effort. Lore Hoyuela does not guarantee specific results in terms of income, followers, sales, or any other business metric.

10.2 Client Decisions: Lore Hoyuela will not be responsible for business decisions made by the client as a result of consulting services. The client is solely responsible for the decisions they make for their personal brand or business.

10.3 Site Availability: Lore Hoyuela does not guarantee the uninterrupted availability of the website and will not be responsible for damages derived from technical interruptions, system errors, or force majeure events.


11. TESTIMONIALS AND SUCCESS STORIES

Testimonials and success stories published on the website reflect real client experiences. The results described are not typical or guaranteed as they depend on multiple individual factors. The results obtained by one client do not imply that other clients will obtain the same results.

12. LINKS TO THIRD PARTIES

The website may contain links to third-party websites. Lore Hoyuela is not responsible for the content, privacy policies, or practices of such sites. The inclusion of links does not imply endorsement or recommendation of them.


13. MODIFICATIONS TO THE TERMS

Lore Hoyuela reserves the right to modify these Terms and Conditions at any time. Modifications will take effect from the moment of their publication on the website. Continued use of the site or contracting of services after the publication of changes implies acceptance of the modified terms.


14. APPLICABLE LAW AND JURISDICTION

These Terms and Conditions are governed by the laws of the Republic of Colombia. For the resolution of any dispute arising from the use of the website or the contracting of services, the parties agree to submit to the jurisdiction of the competent courts of the city of Bogotá, Colombia, expressly waiving any other jurisdiction that may correspond to them.

For users located in the European Union, the rights recognized by the GDPR and the applicable regulations in their country of residence are guaranteed, without prejudice to what is established in this section.
